Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("User") and Individual Entrepreneur Dmitry Mikhailovich Kuzmin, OGRNIP 324632700015672, Samara Region, Russian Federation ("Operator", "we"), governing your use of the Companion AI service, the Telegram bot @CompanionVoiceBot ("Service").

By tapping the consent button in the Service or by using the Service, you accept these Terms in full. If you do not agree, you must not use the Service.

1. Definitions

  • User: a natural person aged 18 or over who has accepted these Terms.
  • Personality: an AI companion created by the Operator, with its own character, communication style and voice. Personalities are fictional and do not represent real people.
  • Balance: the amount of replies available to you, made up of "messages" (text replies) and "voice messages" (voice replies).
  • Pack: a set of messages and/or voice messages bought in one payment: a ready-made pack or a "Custom" pack where you choose the quantities.

2. The Service

2.1. The Service lets you talk to Personalities in text and voice: it replies to your text messages, voice messages and images, searches publicly available information on the internet on request, and lets you top up your Balance and buy Personalities.

2.2. You agree to comply with the Telegram Terms of Service and the law applicable to you.

2.3. The Operator may change the Service's features, including adding, changing and switching off individual features. The Service is provided "as is" and "as available".

3. Age Restriction

3.1. The Service is intended only for persons aged 18 or over. Use of the Service by anyone under 18 is prohibited.

3.2. By accepting these Terms you confirm that you are at least 18 years old. If there are reasons to believe that a User is under 18, the Operator may block their access to the Service.

4. AI Content and Safety

4.1. All replies of the Service are generated by artificial intelligence. Personalities are not people. Replies are for entertainment and are not medical, psychological, legal, financial or any other professional advice.

4.2. Artificial intelligence can make mistakes and produce inaccurate or incomplete information, including information found on the internet. You make significant decisions on your own responsibility.

4.3. Statements of Personalities do not reflect the views of the Operator.

4.4. The Service is not an emergency or mental health service. If a conversation shows signs of a crisis, the Service sends contacts of help services in a separate message. In an emergency, call your local emergency number.

5. Balance and Payments

5.1. New Users receive a free trial amount of messages and voice messages once. After that, the Balance is topped up by buying Packs.

5.2. Payments are made in Telegram Stars. Pack contents and prices are shown in the Service at the time of purchase.

5.3. A text reply uses one message and a voice reply uses one voice message. A voice message you send (up to 15 minutes long) uses one voice message whatever form the reply takes. If no voice messages are left on your balance, your voice message gets a text reply, which uses one message. A unit is deducted only after the reply has been delivered to you. If a reply is not delivered, nothing is deducted.

5.4. Sending images and internet search are not charged separately: the reply uses a message or a voice message as usual.

5.5. Purchased messages and voice messages do not expire.

5.6. The Operator may set technical limits on the use of the Service, including on message frequency, voice message length and the daily number of certain actions. Current limits are shown in the Service.

6. Refunds

6.1. Full refund. If not a single message or voice message from a purchased Pack has been used, you are entitled to a full refund. Payments in Telegram Stars are refunded in full through Telegram.

6.2. Telegram Stars payments can only be refunded in full, so no refund is available for a Pack that has been partly used. The free trial amount is not refundable.

6.3. By starting to use a purchased Pack you request immediate performance of the service and acknowledge that you lose the right of withdrawal for the part of the service already provided, where applicable consumer law provides for such a right.

6.4. To request a refund, contact support at @HelpCompanionVoiceBot or support@amourvoice.com, stating your Telegram ID, the date and amount of the payment and your request. Refunds are made by the original payment method. After a refund, the corresponding messages and voice messages are removed from your Balance.

6.5. Nothing in this section limits the mandatory rights you have as a consumer under the law of your country of residence.

7. Personalities (Digital Content)

7.1. Some Personalities are free, others are bought separately. Buying a Personality gives you a non-exclusive right to use it in the Service for as long as it is available in the Service. Conversations with a purchased Personality use messages and voice messages from your Balance as usual.

7.2. By buying a Personality you expressly consent to its immediate delivery from the moment of payment and acknowledge that you thereby lose your right of withdrawal (Art. 16(m) of Directive 2011/83/EU). A refund for a Personality is made only if it was not delivered due to a technical error of the Service.

7.3. The Operator may change and update Personalities (including their character, communication style and voice) and withdraw them from the Service.

8. Prohibited Use

8.1. You must not:

  • use the Service if you are under 18;
  • send spam or make automated requests using scripts, bots or other software;
  • attempt unauthorized access to the Service, hack it or reverse engineer it;
  • use the Service to create, distribute or store unlawful content, including any sexual content involving minors;
  • transfer or resell access to the Service, messages or voice messages to third parties;
  • abuse the free trial or commit payment fraud;
  • circumvent or attempt to circumvent the Service's safety mechanisms, including by prompt injection, jailbreak attempts, role-play manipulation, social engineering or any other technique aimed at obtaining content that violates these Terms, the rules of AI technology providers or applicable law.

8.2. A breach is grounds for restricting or terminating your access to the Service.

9. Intellectual Property

9.1. All rights in the Service and its elements, including Personalities, belong to the Operator. These Terms grant you only a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.

10. Limitation of Liability

10.1. To the maximum extent permitted by applicable law, the Operator does not warrant uninterrupted or error-free operation of the Service or the accuracy and completeness of replies, and may suspend the Service for maintenance.

10.2. The Operator is not liable for decisions you make based on replies of the Service, for the actions of third parties (technology providers, payment services, the Telegram platform), or for losses caused by your breach of these Terms or the law.

10.3. If prohibited or unlawful content is obtained from the Service through your deliberate manipulation of prompts, circumvention of safety mechanisms or other bad-faith conduct, you are solely responsible for that content and its use.

10.4. The Operator's aggregate liability for any claims shall not exceed the amount you paid in the 30 calendar days preceding the event giving rise to the claim.

10.5. Nothing in these Terms limits liability that cannot be limited under applicable law or your mandatory rights as a consumer.

11. Indemnification

You agree to indemnify the Operator against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, applicable law or the rights of third parties, to the extent permitted by applicable law.

12. Termination

12.1. You may stop using the Service at any time.

12.2. The Operator may restrict, suspend or terminate your access in case of a breach of these Terms, including the age restriction, reasonable suspicion of fraud, or a lawful request of competent authorities.

12.3. If access is terminated by the Operator, the unused part of your Balance may be refunded under Section 6.

13. Personal Data

13.1. Processing of your personal data is governed by the Privacy Policy and is based on the separate Consent to Personal Data Processing.

13.2. The /clear command deletes the conversation history and memory with the selected Personality. Full deletion of your data is available on request to support.

14. Governing Law and Disputes

14.1. These Terms are governed by the law of the Russian Federation, without prejudice to the mandatory consumer protection rules of your country of residence.

14.2. We try to resolve any dispute through negotiation first: please contact support before going to court.

15. Changes to These Terms

15.1. The Operator may amend these Terms. The current version is available at amourvoice.com/terms/international/. We notify you of material changes in the Service. Continued use of the Service after the changes take effect means you accept them.

16. Miscellaneous

16.1. If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in effect.

16.2. The Operator's failure to enforce any provision is not a waiver of that right.
